Welcome to MechMind Pro! These Terms of Service ("Terms") govern your access to and use of the MechMind Pro website and services ("Services"), provided by MechMind Pro ("we," "our," or "us"). By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Services

MechMind Pro provides a platform that uses artificial intelligence (AI) to assist users in identifying mechanical parts and specific part numbers based on user-submitted vehicle and equipment details (including Make, Model, Year, and part descriptions).

2. Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract with MechMind Pro. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use MechMind Pro, you must register for an account and provide accurate and complete information, including your first name, last name, and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment and Subscription

a. Fees:

Access to certain features of MechMind Pro requires a paid subscription. Subscription pricing is as listed at the time of purchase and may be updated periodically.

b. Billing:

Subscriptions are billed on a monthly basis in advance. You may cancel or modify your subscription at any time through your account settings. If you cancel, your access will continue until the end of the current billing cycle.

c. Payment Methods:

We accept payment through secure third-party providers such as Stripe. By providing a payment method, you authorize us to charge your method for the applicable fees.

d. Refund Policy:

Subscriptions are non-refundable.

e. Stripe Terms:

All payments are processed by Stripe. By using our Services, you agree to be bound by Stripe's Terms of Service and Privacy Policy.

f. Failed Payments:

If your payment fails or cannot be processed, we may suspend your access to the Services until the issue is resolved.

5. User Conduct

a. Compliance:

You agree to comply with all applicable laws and regulations in your use of the Services.

b. Prohibited Activities:

You agree not to:

  • Use the Services for unlawful, harmful, or fraudulent purposes;
  • Submit misleading or inaccurate part information;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Create multiple accounts without permission.

6. Use of AI and External Services

MechMind Pro uses OpenAI's API to process user-submitted part requests and assist in generating potential part matches. While we strive to ensure helpful and accurate outputs, the AI-generated responses are not guaranteed to be correct, complete, or up-to-date.

Important Disclaimer:

All suggestions, including part numbers, are generated by AI and are provided for informational purposes only. It is the user's sole responsibility to verify any part number or product recommendation with a qualified source prior to purchase or installation. MechMind Pro makes no warranties or representations as to the accuracy of any part-related information provided.

Limitation of Responsibility:

MechMind Pro shall not be liable for any damages—direct, indirect, incidental, or consequential—arising out of or related to the use of an incorrect part number or part recommendation provided by the Services.

7. Intellectual Property

All intellectual property rights in the Services—including code, design, branding, and AI tools—are owned by MechMind Pro or its licensors. You may not copy, distribute, reverse-engineer, or exploit any part of the Services without written permission.

8. Data Privacy

We collect, use, and protect your data in accordance with our Privacy Policy. By using the Services, you consent to our data practices.

9. Termination

a. Termination by You:

You may cancel your subscription and delete your account at any time via your account settings.

b. Termination by Us:

We may suspend or terminate your account at any time, with or without notice, if we believe you've violated these Terms or misused the Services.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, accurate, or error-free, or that the results generated will be suitable for any specific purpose.

11. Limitation of Liability

To the fullest extent permitted by law, MechMind Pro shall not be liable for any indirect, incidental, special, or consequential damages—including lost profits, loss of data, business interruption, or any damages resulting from reliance on AI-generated part numbers or recommendations.

12. Indemnification

You agree to indemnify and hold harmless MechMind Pro, its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Services or violation of these Terms.

13. Governing Law

These Terms and your use of the Services are governed by the laws of the Province of British Columbia and the laws of Canada, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the website or by email. Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
